Fika Terms of Use

1. The Fika Service

Fika is a technology platform that enables users to publish content, distribute digital works, and offer subscriptions or memberships.

Fika provides hosting, distribution, and payment facilitation tools but does not create, own, or control user content.

2. Eligibility

You must be at least 16 years old to use Fika.

If you use the Service on behalf of an organization, you represent that you have authority to bind that entity to these Terms.

3. Account Registration and Security

You may need an account to access certain features. You agree to:

• provide accurate information
• maintain the confidentiality of your credentials
• be responsible for activity under your account

You must notify us of unauthorized access.

4. User Roles

Users may participate as:

• Readers, who consume or purchase content.
• Creators, who publish content or offer paid access.

Additional obligations apply when you enable monetization features.

5. Marketplace Relationship

Fika provides a platform connecting creators and readers.

Unless explicitly stated otherwise:

• Creators sell content directly to readers.
• Creators act as the Merchant of Record for their offerings.
• Fika is not the seller of creator content.
• Transactions form a direct contract between creator and reader.
• Fika is not a party to these transactions.

Fika does not guarantee the quality, legality, safety, or delivery of creator offerings.

6. User Content and License

You retain ownership of content you publish (“User Content”).

By publishing content, you grant Fika a worldwide, non-exclusive, royalty-free license to host, display, reproduce, modify, and distribute your content solely to operate and improve the Service.

You represent that you have all necessary rights to publish your content.

Fika may remove content that violates these Terms or applicable law.

7. Acceptable Use

You agree not to:

• violate laws or regulations
• infringe intellectual property rights
• publish illegal, harmful, or fraudulent content
• distribute spam or automated abuse
• interfere with platform security
• attempt unauthorized access
• reverse engineer or extract source code

8. Content Moderation and Platform Integrity

Fika may review, remove, restrict, or disable content or accounts to:

• enforce these Terms
• comply with legal obligations
• protect users or platform integrity
• prevent fraud or abuse

We are not obligated to monitor all content.

9. Digital Services Act (EU) Compliance

For users located in the European Union:

• Users may report illegal content through designated reporting channels.
• Fika may remove or restrict content following review.
• Users may appeal moderation decisions where applicable.
• Fika may publish transparency reports if required by law.

10. Monetization and Creator Responsibilities

By enabling monetization features, you agree that:

You act as the seller and Merchant of Record for your offerings.

You are solely responsible for:

• pricing and commercial terms
• fulfillment of benefits
• customer support
• refund policies
• dispute resolution
• advertising transparency
• compliance with consumer protection laws
• tax obligations

You enter a direct contractual relationship with readers purchasing your content.

11. Payment Processing

Fika may facilitate payments using third-party providers (such as Stripe).

By using monetization features, you:

• authorize Fika to transmit payment data
• agree to payment provider terms
• consent to identity verification and compliance checks
• authorize payment providers to process payments on your behalf

Fika is not a bank or financial institution.

12. Platform Fees

Fika may charge platform fees for monetization features.

By enabling paid services, you authorize Fika to:

• collect platform fees
• deduct fees from transactions
• modify fee structures with reasonable notice

Fees are disclosed when monetization is enabled.

13. Payout Authorization

Creators authorize Fika and its payment providers to:

• receive funds from readers on their behalf
• deduct fees, refunds, and chargebacks
• transfer remaining amounts to designated accounts

Payouts may be delayed or withheld to manage risk, fraud, legal compliance, or disputes.

14. Taxes and Reporting

Creators are responsible for determining, collecting, reporting, and paying all applicable taxes related to their sales, including VAT or similar taxes unless explicitly stated otherwise.

Fika may collect tax or identity information and report earnings to tax authorities where required, including under EU DAC7 or similar regulations.

Fika does not provide tax advice.

15. Refunds, Disputes, and Chargebacks

Creators are responsible for refunds and dispute handling related to their offerings.

Fika may recover refund or chargeback amounts from creator balances.

Fika may provide dispute handling tools but assumes no liability.

16. Purchases and Subscriptions

When purchasing paid content:

• you contract directly with the creator
• creators define pricing and benefits
• Fika facilitates payment processing only

Subscriptions automatically renew unless cancelled.

You authorize recurring charges until cancellation. Cancellation applies to future billing periods unless otherwise stated.

17. EU Consumer Rights for Digital Content

Where permitted by law, readers purchasing digital content consent to immediate access and acknowledge that statutory withdrawal rights may be waived once access begins.

Creators must clearly communicate applicable terms.

18. Third-Party Services

Fika may integrate third-party services. Their use is governed by their own terms.

Fika is not responsible for third-party services.

19. Intellectual Property of Fika

All platform software, design, and materials (excluding User Content) are owned by RamenSoft SL or licensors and protected by intellectual property laws.

20. Account Suspension and Termination

You may stop using the Service at any time.

Fika may suspend or terminate accounts for violations, risk management, or legal compliance.

21. Disclaimers

The Service is provided “as is” without warranties of any kind.

Fika does not guarantee uninterrupted, secure, or error-free operation.

22. Limitation of Liability

To the maximum extent permitted by law, Fika is not liable for indirect, incidental, or consequential damages arising from use of the Service.

23. Indemnification

You agree to indemnify and hold harmless Fika from claims arising from:

• your content
• your transactions
• your legal violations
• your use of the Service

24. Changes to the Service

Fika may modify, suspend, or discontinue features at any time.

25. Governing Law and Jurisdiction

These Terms are governed by the laws of Spain.

Disputes shall be subject to the courts of Barcelona, Spain, unless mandatory consumer protection law provides otherwise.

EU consumers retain statutory rights under applicable law.

26. Changes to These Terms

We may update these Terms from time to time.

Material changes will be communicated via email or platform notice. Continued use of the Service constitutes acceptance.
